SUMMARY OF COMPLAINT
This formal online Omnibus Complaint details an ongoing scheme of evidentiary fabrication, docket manipulation, and civil rights violations committed by defense counsel and corporate represntatives in the present civil action.
This matter encompasses the intentional fabrication of a commercial financial transaction receipt and systematic destruction of evidence by Verizon Wireless, five perjured declarations submitted by four distinct individuals, and unlawful, preferential court hearing calendaring executed by the presiding judge and her departmental staff.
I was the victim of a fraudulent bait-and-switch scheme orchestrated by Verizon Wireless and its authorized retailer, Cellular Sales, wherein they refused to honor agreed-upon contract terms covering two iPhone 16 Pro devices. When I initiated a small claims action to recover my losses, Verizon fabricated a manufactured "Customer Receipt" to refute my claims and systematically wiped my online customer portal to erase all authentic contract records.
In response, I launched public awareness websites to document and expose this fraudulent conduct, after which Verizon and its legal counsel contacted me in an effort to compel the removal of those platforms.
Proceeding pro se and in forma pauperis, I filed an Emergency Motion for a Temporary Restraining Order (TRO) to enjoin Defendants from relying on the manufactured receipt and to halt their retaliatory efforts to suppress my consumer protection websites. In response, Verizon Wireless and Cellular Sales deployed five attorneys across three jurisdictions, submitting five perjured declarations authored by four distinct individuals: two defense attorneys, a corporate executive/manager, and the presiding judge—who subsequently submitted a perjurious declaration after I moved to disqualify her for systemic violations of my constitutional rights.
As I sought to expose these fraudulent filings, it became evident that defense counsel was operating in tandem with the presiding judge and her departmental court clerk to subvert my constitutional due process rights. Specifically, the court systematically withheld and suppressed my pending motions from the calendar while engaging in improper ex parte administrative practices to grant expedited, off-hours docketing for defense filings. Following my service of a statutory Motion for Disqualification, the judge escalated her retaliatory conduct by refusing to stay proceedings, altering case entries, and submitting a sworn declaration denying all bias—despite clear objective evidence of docket manipulation, bad-faith coordination, and administrative misconduct.
Consequently, this matter now encompasses five perjured declarations submitted by four distinct individuals—a fraud scheme directly integrated with Verizon Wireless’s deliberate manufacturing and destruction of material evidence:
■ Spoliation of Digital Evidence: Systemic deletion and suppression of critical electronic records, account histories, and audit logs subject to mandatory litigation preservation rules.
■ Manufacturing of False Records: Active creation and submission of altered internal documentation to fraudulently corroborate sworn perjurious statements.
■ Subversion of Judicial Administration: A coordinated effort between corporate representatives and defense counsel to pervert due process and mislead the tribunal.
I submit this affidavit to trigger immediate, multi-jurisdictional criminal, civil, and disciplinary enforcement action across the listed federal and state oversight agencies.
SYSTEMIC ABUSE OF CONSUMER RIGHTS AND NOTICE OF PUBLIC MEDIA EXPOSURE
Rather than engaging in good-faith dispute resolution, Defendants and their attorneys have deliberately prolonged this litigation as an act of bad-faith retaliation for Complainant’s exercise of First Amendment rights in publishing public exposure websites.
By employing delaying tactics, filing meritless motions, and executing unauthorized docket manipulations, defense counsel has willfully escalated procedural costs and artificial delays to punish me for exposing their misconduct to the public. This retaliatory strategy—designed to drain my resources and evade an on-the-merits adjudication of their underlying fraud—constitutes a clear abuse of the judicial process and further establishes bad-faith litigation conduct warranting dispositive sanctions under Rule 11 and NRS 7.085.
When this dispute first arose, my repeated attempts to raise these critical issues were systematically ignored, effectively signaling to the Respondents that they could break the law with impunity and escalate their misconduct without fear of consequence. This brazen disregard highlights a pervasive system in which the fundamental rights of everyday consumers are routinely trampled by giant corporations while courts and regulatory bodies look the other way. Consequently, dedicated public information websites have been established to expose these abuses directly to the media and the public, ensuring full public accountability should oversight agencies and law enforcement continue to ignore this complaint.
STATEMENT OF FACTS
1. Deceptive Telephonic Agreement & Systematic Breach of Contract
I entered into an enforceable oral contract with Verizon Wireless and its authorized retailer, Cellular Sales, via telephone for a bundled cellular and home internet package. This agreement was based on explicit pricing, service terms, and promotional commitments offered by Verizon's sales representative during a marketing call.
Immediately upon obtaining my consent to the terms and initiating the porting of my phone number—effectively stranding my service—Verizon abruptly terminated the call. Verizon then forced me to visit a local retail store to complete setup, where store personnel refused to honor the agreed-upon telephonic terms. Verizon issued new verbal and written assurances to induce me into completing the transaction, only to subsequently breach those secondary agreements as well through unauthorized billing and unfulfilled plan commitments.
2. Unlawful Post-Cancellation Billing
Following my formal cancellation of services, Verizon continuously and improperly billed me over a ten-month period for unauthorized fees, refusing to rectify the erroneous account balances.
3. Account Data Erasure, Creation of Fabricated Receipt, & Initiation of Small Claims Action
I initiated a Small Claims action to recover losses resulting from Verizon's fraudulent billing.
In response, Verizon systematically wiped out my online account profile data and scrubbed actual historical billing records from their system. Defendants then fabricated a fictitious receipt—purporting to substantiate their claims—which they submitted to the court despite being completely unable to authenticate its origin, transaction details, or underlying ledger entries.
4. Public Awareness Efforts, Retaliation, & Injunctive Relief (TRO)
In response to my establishing public awareness websites documenting Verizon's business practices, Verizon engaged in retaliatory tactics and threats which forced me to file a Motion for a Temporary Restraining Order (TRO) and Preliminary Injunction on June 23, 2026, to enjoin Verizon from utilizing the fraudulent receipt and harassing me regarding the informational websites.
5. Institutional Collusion, Procedural Sabotage, & Civil Rights Violations
During the proceedings, four corporate defense attorneys, the presiding judge, and court clerk personnel engaged in systemic abuse of power, improper ex parte communications, and deliberate violations of my due process rights. Specifically, court personnel intentionally delayed scheduling hearings for my pending motions, while fast-tracking defense hearings through off-hours filings and ex parte channels.
Furthermore, the presiding judge improperly issued rulings and advanced the defense's agenda in direct violation of statutory stay requirements after being served with a formal Notice of Disqualification, which legally stripped her of authority to take further action in the case.
6. Perjured Jurisdictional Declarations & Fraudulent Evidence
Cellular Sales submitted perjured declarations falsely asserting zero jurisdictional contacts within Nevada, despite maintaining active, continuous regional management and recruitment operations in the state. Concurrently, Verizon insisted on the authenticity of its fraudulent receipt while refusing to disclose the standard 28-digit receipt verification number that would conclusively establish its invalidity.
7. Bad-Faith Vexatious Motions, Judicial Shielding, & Refusal of Recusal
Defense counsel colluded to seek dismissal and have Plaintiff declared a vexatious litigant to suppress the litigation. The presiding judge violated Judicial Canons by actively shielding defense counsel from disciplinary oversight, refusing mandatory reporting of attorney misconduct, denying Plaintiff's disqualification requests, and demonstrating overt bias in favor of corporate counsel.
8. Conclusion & Demand for Oversight
Because the judicial forum has failed to execute its statutory and constitutional duties—instead actively protecting corporate bad-faith litigation and attorney fraud—formal administrative, disciplinary, and judicial oversight bodies must intervene to enforce accountability. Absent regulatory enforcement, these systemic abuses will be brought before the public to expose institutional non-compliance and the denial of due process.
A. Verizon Misconduct
DION MORROW (Legal Liaison)
Morrow submitted false statements to both the FCC and the Nevada Attorney General in response to my administrative complaints, claiming Verizon had fully resolved all billing disputes and framing my subsequent small claims filing as frivolous. These representations caused both agencies to drop the investigations.
Morrow expressed hostility regarding my public awareness websites and explicitly demanded their removal.

Exposing Verizon’s False Claims Regarding Promotional Deals
Verizon rep, Dion Morrow, and Verizon attorneys claim the Red Hot Deal of 2025 promotion never existed. The official video below proves otherwise. Watch the original Verizon advertisement detailing the exact terms, trade-in conditions, and promotional pricing they now claim were "never offered."

Red Hot Deal Days
LEONARD T. FINK (Defense Counsel)
Despite clear evidence of Verizon’s "Red Hot Deal" promotion (active May 15–May 28, 2025) offering an iPhone trade-in promotion during my May 18 transaction, Fink and Verizon filed oppositions and answers denying the existence of any promotional deal.
Fink continues to base Verizon’s defense on a manufactured customer receipt containing severe, demonstrable defects:
- Complete absence of my signature.
- Inaccurate sales terms listing uncharged and unpaid figures.
- Classification as a phone order with two separate transaction numbers, despite occurring in-store.
- Issuance dated a day prior to the actual transaction.
- Contradictory pricing listing an $1,100 phone as free while assessing a $1,200 charge.
- False claims of a trade-in for a device that was stolen.
- A claimed $100.50 tax payment on May 18, 2025, directly contradicted by bank records (showing my last payment was $87.06 on April 28, 2025 for internet service prior to July 5 cancellation) and unsupported by any 28-digit authentication number.
- The purported agreement forces a significantly higher monthly service premium than the rate previously paid prior to enrolling in Verizon cellular service, offering zero commercial or financial benefit.
- The document purports that coverage for device loss and theft was intentionally declined—at the exact time a replacement phone was required due to a recent device theft for which active coverage was already in place under the prior policy.
- It defies reason that a consumer would voluntarily surrender a valid, active claim for full financial reimbursement on a stolen device, only to sign up for a more expensive replacement plan that offers inferior benefits.

Fink and Morrow have resisted evidentiary disclosures, claiming proof is unnecessary prior to formal discovery, while actively refusing to participate in the statutorily mandated early case conference.
Despite my good-faith settlement offers, Fink has prolonged litigation without producing supporting evidence, seeking to secure a dismissal piggybacking on Cellular Sales' motions.
1. Fraudulent Denial and Concealment of "Red Hot Deal" Promotional Terms
On May 18, 2025, Defendants induced me into executing a transaction under the explicit contractual representations of the "Red Hot Deal" promotional offering. However, when disputes arose regarding account billing and terms, Defendants falsely claimed that no such promotion existed on that date, flatly denying the terms offered to Complainant. To perpetuate this cover-up, Defendants intentionally withheld official promotional documentation, concealed point-of-sale promotional terms, and falsely asserted in court filings that Complainant's account was governed by standard, non-discounted rate plans—a deliberate misrepresentation designed to evade liability for deceptive trade practices and breach of contract.
Contrary to Defendants' fraudulent assertions denying the existence of the promotional terms on May 18, 2025, objective documentary evidence confirms that the offering was actively advertised and solicited to the public. As captured in the official record, a verified screenshot of the promotional Instagram post published on May 28, 2025 explicitly detailing the "Red Hot Deal" terms, activation parameters, and effective dates can be viewed below:
2. Manufacturing of False and Altered Transactional Receipt
In a direct effort to cover up unauthorized charges and conceal the true contractual terms agreed upon on May 18, 2025, Defendants manufactured and uttered a falsified, altered sales receipt. Defendants intentionally altered core transactional data—including itemized line items, applied promotional credits, device pricing, and account authorization signatures—to create a fraudulent record that contradicted the actual point-of-sale agreement. This fabricated document was subsequently utilized by Defendants to deceptively justify improper account billings, evade regulatory scrutiny, and submit false factual assertions to the Court in an attempt to subvert the judicial process.
To demonstrate Defendants' active fabrication and alteration of transactional records, a verified screenshot of the falsified, manufactured receipt—exposing the altered line items, manipulated totals, and improper account entries—is attached below:

B. Cellular Sales Misconduct
LARRY CARBO (Defense Counsel)
On July 28, 2026 (the response to complaint deadline), Carbo called claiming Cellular Sales lacked local counsel and requested an extension to August 11, 2026. Upon learning local counsel Gavish was already retained, agreement to extend the answer for the original complaint was rescinded.
After failing to confirm acceptance of the First Amended Complaint (FAC) via email, Carbo executed a false declaration claiming an agreement was reached to extend the deadline to answer the original complaint.
In a subsequent perjured declaration, Carbo falsely asserted that Cellular Sales of Knoxville has no contact with Nevada.

JONAH GAVISH (Defense Counsel)
On July 31, 2026, Gavish filed an ex parte motion via direct email rather than the district court's e-filing system to set aside a default entered on July 29.
The motion included a declaration containing six false statements alleging that Cellular Sales of Knoxville is purely a local Tennessee entity with zero Nevada contacts, while falsely asserting an agreement existed regarding the extension stipulation despite acknowledging it was never signed.

RYAN J. WORKS (Defense Counsel)
On August 1, 2026, Works assumed lead representation, demanded the immediate surrender of jonahgavish.com, and re-filed the motion containing the known false declarations of Gavish and Carbo.
On August 17, 2026, Works filed a Motion to Dismiss and Motion to Declare Plaintiff a Vexatious Litigant, attaching another false declaration from Carbo. Works highlighted my public awareness websites targeting judicial figures to prejudice Judge Delaney while intentionally omitting his own website domain from the filing.

PAMELA WHITE (CFO)
Defense counsel initially sought to secure a swift dismissal by falsely characterizing the corporate structure and jurisdictional footprint of CSOKI. In their initial Motion to Dismiss filed on August 2, Defendants asserted that CSOKI was merely a local Tennessee entity with zero operational connections to the State of Nevada.
Works subsequently withdrew the prior motion and refiled an updated version containing a declaration from Cellular Sales CFO Pamela White.
Pamela White serves as Chief Financial Officer (CFO) and executive manager of Cellular Sales. Public records and corporate documentation detail the operational framework, subsidiary control structures, and regional management hierarchy across Cellular Sales entities, including Cellular Sales of Knoxville, Inc. ("CSOKI") and Cellular Sales of Nevada, LLC ("CSON").
This core factual claim was directly disproven when Complainant produced official state regulatory filings identifying Pamela White (Chief Financial Officer of CSOKI) and Thomas K. Reeves (Chief Counsel of CSOKI) as designated local managers.
Confronted with undeniable public records demonstrating local management authority, Defendants abruptly withdrew their August 17 Motion to Dismiss and refiled a revised motion on August 18. To circumvent the official state filings, Defendants attached a sworn declaration from Pamela White containing deliberate misrepresentations:
■ Contradictory Corporate Positioning: While acknowledging CSOKI’s status as a broad corporate enterprise to account for her newly exposed managerial role, White explicitly denied under penalty of perjury that CSOKI maintains any business dealings, operations, or presence in Nevada.
■ Omission of Local Leadership Structure: This denial was executed despite full knowledge that CSOKI maintains regional executive leadership—including regional presidents operating within Nevada—actively managing core elements of the business within the jurisdiction.
The tactical withdrawal and immediate refiling of the Motion to Dismiss on August 18—supported by White’s perjurious declaration—demonstrates a deliberate effort to alter factual positions in bad faith when exposed by public records, misleading the tribunal to avoid state court jurisdiction.
White executed a declaration asserting that Cellular Sales of Knoxville (CSOKI/CSOKT) maintains no employees, conducts no operations, and exercises no policy oversight over its Nevada subsidiaries.
White’s statements directly omit her own role as a named manager in Nevada state corporate filings along with Thomas K. Reeves, Chief Counsel with Cellular Sales. Furthermore, official company web pages list 34 regional managers—including Angel Caraballo and Aaron Schmidt—who actively manage operational policies and employee training within Nevada.
Following these filings, Works, Gavish, and Carbo blocked email communications, ignored early case conference obligations, and refused good-faith settlement discussions.

II. REGIONAL LEADERSHIP DISCLOSURES
■ Headquarters Guidance: Cellular Sales headquarters in Knoxville, TN directs market leaders and regional presidents across the country.
■ Nevada Management: Public records highlight two key regional leaders for the State of Nevada: Angel Caraballo and Aaron Schmidt.
■ Angel Caraballo: IIdentified via Cellular sales's official web page and RocketReach as Regional Director/President based in Las Vegas, NV, possessing skills in customer retention, recruitment, team leadership, and employee training. Caraballo is located at 6843 Compass Street, North Las Vegas, Nevada. His wife Rose Caraballo, is a Cellular Sales recruiter.
■ Aaron Schmidt: Identified via Cellular Sales's official web page as Regional President. Schmidt is located at 10557 Sariah Skye Avenue, Las Vegas, Nevada.
■ Retail Network: Cellular Sales operates as Verizon's premier retail partner, maintaining nearly 850 stores across 45 states.

V. CELLULAR SALES EMPLOYEES IN LAS VEGAS
Pictured below, Aaron Schmidt and Angel Caraballo are listed on Cellular Sales' web pages as Nevada Regional Presidents, while Rose Caraballo is listed as a Recruiter.■ Aaron Schmidt is currently listed as an active Cellular Sales employee. He resides at 10557 Sariah Skye Ave, Las Vegas, NV 89166 with an operational corporate email address at Aaron.Schmidt@cellularsales.com.
■ Angel Caraballo is currently listed as an active employee. He resides at 6843 Compass St North Las Vegas, NV 89084 with an operational corporate email address at Angel.Caraballo@cellularsales.com.
■ Rose Caraballo is currently listed as an active employee. She reside at 6843 Compass St North Las Vegas, NV 89084 with an operational corporate email address at Rose.Caraballo@cellularsales.com.
This evidence directly contradicts the company's sworn testimony asserting that Cellular Sales maintains no corporate or operational connection to Nevada stores.

The individual retail locations—including the store at 3825 S. Maryland Parkway—are non-autonomous entities controlled entirely by the parent company rather than independently owned franchises, making it legally impossible to sue an individual store as an independent corporate entity. Consequently, Cellular Sales of Knoxville, Inc. uses this corporate shell structure to shield itself from liability while simultaneously arguing that the parent entity cannot be sued locally.
C. Eighth Judicial District Constitutional & Procedural Violations
KATHLEEN E. DELANEY (Judge )
Despite a duty under Rule 2.15 of the Nevada Code of Judicial Conduct to respond to known attorney misconduct, Judge Delaney has refused to address or sanction defense counsel’s submission of fabricated evidence and perjured declarations.
Judge Delaney has actively manipulated the court calendaring system to favor corporate defendants by permitting off-hours scheduling for defense motions while systematically suppressing pending applications for sanctions. Additionally, she continues to set future hearing dates past her pending September 16 disqualification hearing.
In her sworn declaration responding to my Motion to Disqualify for Cause filed August 10, 2026, Judge Delaney falsely represented the record. She claimed under penalty of perjury that except for timing adjustments and her voluntary recusal, all relief in my Emergency Motion to Consolidate [Dkt. 45] had been granted.
Judge Delaney’s sworn statement is directly refuted by the docket, which reveals three suppressed or omitted motions:
Judge Delaney’s sworn assertion that all requested relief had been addressed is directly refuted by official court records, which demonstrate the ongoing suppression and omission of three critical motions:
• Motion 1 (Emergency Motion for Temporary Restraining Order (TRO) & Preliminary Injunction – Filed June 23, 2026): This request for emergency injunctive relief is finally scheduled for hearing on September 15, 2026—nearly three full months after its initial filing—following a deliberate pattern of calendar manipulation by the presiding judge designed to suppress the motion and keep it off the active docket.• Motion 2 (First Amended Motion for Case-Dispositive Terminating Sanctions – Filed August 4, 2026): Originally submitted as an amendment to a prior filing, this motion was completely ignored following Judge Delaney's denial of the underlying consolidation request—a ruling that clearly evinced judicial bias aimed at insulating counsel from pending sanction proceedings. It was only after I formally established that her recusal declaration contained demonstrably false statements regarding unscheduled emergency motions that this matter was abruptly added to the September 15 hearing calendar.
The fact that it is now listed on the docket as an amended motion—devoid of any official Notice of Hearing or standard electronic calendaring entry—proves that Judge Delaney manually inserted the filing onto the docket purely in response to my factual showing of perjury.
• Motion 3 (Motion for Sanctions, Costs, Expenses, and Fees – Filed August 4, 2026): Originally calendared for September 1, 2026, this motion for monetary and evidentiary sanctions was retaliatorily removed from the calendar after I objected to Judge Delaney's rulings. Following my formal objection to its omission from the September 8 calendar, the court reset the matter for September 15. Because Defendants failed to file a timely opposition—a default caused by the court's arbitrary scheduling—I filed a Notice of Non-Response on August 19, 2026, requesting the entry of an order granting the requested relief without a hearing.
In light of this default, I attempted to engage Defendants in an early dispute conference to resolve the matter. Instead of conferring in good faith, Defendants blocked my email communications and retaliated by filing motions to dismiss and to declare me a vexatious litigant. Judge Delaney then refused to sign the unopposed order—which mandated $3,000 in sanctions and a State Bar referral—and instead improperly reset the hearing for September 22, 2026, to grant Defendants an unmerited second chance to oppose the motion.
Consequently, two separate hearing dates (September 15 and September 22, 2026) currently sit on the active docket for the exact same motion, demonstrating severe docket manipulation and procedural bias and negligence.
• Motion 4 (Motion for Sanctions, Costs, Expenses, and Fees – Filed August 19, 2026): After Defendants deliberately blocked my email communications—in direct violation of their ethical duties to confer and communicate under Nevada Rules of Professional Conduct (NRPC) 3.4 (Fairness to Opposing Party and Counsel) and 8.4(d) (Conduct Prejudicial to the Administration of Justice)—I filed a corresponding Motion for Sanctions.
As of the date of this filing, the court has completely ignored my motion, leaving it unscheduled. In stark contrast, Defendants' motions receive rapid-fire docketing, often being scheduled within hours of their submission, even when filed outside of standard business hours. This flagrant calendaring manipulation actively prejudices my case while demonstrating the court's undeniable procedural favoritism toward the defense.
APRIL WATKINS (Clerk )
Court records indicate direct involvement in managing and altering off-hours court settings under Judge Delaney’s direction, ensuring preferential docketing for defense motions while obstructing the calendaring of pending sanction applications.
The court’s docket manipulation and procedural delays constitute direct retaliation for my publication of kathleendelaney.online and reflect clear, disqualifying judicial bias.
